A sworn officer of the St. Cloud Police Department duly states the following facts establish PROBABLE CAUSE: On or about September 18, 2025 at approximately 6:56PM officers were dispatched to a possible vehicle crash at [ADDRESS REDACTED], City of St. Cloud, County of Benton, State of Minnesota. Dispatch advised that a vehicle struck a power pole. Upon arrival, Officer Carla Hemminger observed a gray 2017 Chevrolet Cruze bearing Minnesota license plate [PLATE REDACTED] that had left the roadway and crashed into a power pole.
After approaching the vehicle, Officer Hemminger observed it to be unoccupied. Airbags had deployed and the dash lights were on. She also observed on the driver's seat, in plain view, a brown paper cigarette or join that was partially burnt on one end, containing a leafy substance consistent with marijuana. A female standing outside of the vehicle approached Officer Hemminger, later identified by her Minnesota driver's license as Ubah Abdinosir Cabdulaahi, [DOB REDACTED], the Defendant herein, and stated that she was the driver, and sole occupant, of the vehicle.
Officer Hemminger observed an odor of alcohol emanating from the Defendant's breath and also observed the Defendant's eyelids to be droopy. The Defendant to be very fidgety. She stated that she dozed off while turning around which caused her to crash. She denied consuming any alcohol prior to driving, stating only that she consumed three shots of vodka and three vodka mixed drinks during the previous evening. The Defendant denied smoking marijuana. Officer Hemminger requested that the Defendant perform standardized field sobriety tests.
The Defendant complied and performed HGN and one-leg stand, but refused other tests. During testing, Officer Hemminger observed multiple validated clues of impairment. The Defendant refused to provide a preliminary breath test sample and refused to participate in an evaluation to determine impairment due to drugs. Based on the suspicion of impairment and the suspected marijuana roach, officers conducted a search of the Defendant's vehicle. Officer Bares located a small bottle of moonshine in the front passenger seat and a bottle of vodka in the back passenger seat.
Both bottles were open and had alcohol in them. Officer Hemminger placed the Defendant under arrest for suspicion of driving while impaired and transported her to the St. Cloud Hospital. At 8:19PM, Officer Hemminger applied for a search warrant to obtain a sample of the Defendant's blood or urine. At 8:20PM, the Honorable Judge William Cashman approved and issued the warrant. Officer Hemminger presented the warrant to the Defendant. The Defendant refused to provide a sample of blood or urine. Officer Hemminger deemed the refusal a test refusal.
