On November 2, 2025, at approximately 4:20 P.M., Hopkins police officer N. Colleran received a report of a vehicle bearing Minnesota license plate [PLATE REDACTED] swerving in and out of traffic lanes, almost hitting another vehicle and was now parked at Ace Spirits located at [ADDRESS REDACTED] in the city of Hopkins. Officer N. Colleran responded and observed the vehicle parked outside the business and a female later identified as Susan Joan Kraft, [DOB REDACTED], the defendant herein, walk out of the store and get into the vehicle.
Officer N. Colleran followed the vehicle and observed it take a right and fail to signal its turn. As Officer N. Colleran followed the vehicle westbound on Excelsior Boulevard, he observed it weave and cross the fog line before it corrected back onto the roadway and as it took a northbound turn onto Fairview Avenue it turned all the way into the southbound side of the road, traveling the wrong way. Officer N. Colleran stopped the vehicle near [ADDRESS REDACTED] in the city of Minnetonka, county of Hennepin, Minnesota and identified the driver as the defendant.
In speaking with the defendant, Officer N. Colleran detected an odor of an alcoholic beverage, observed her eyes were watery/glassy and noted her speech was slurred. The defendant denied coming from Ace Spirits and appeared confused. Officer N. Colleran also observed her movements were slow and deliberate. When the defendant was asked if she had any alcohol to drink that day she stated she was making a turkey and stated “if I did I would have had a sip of wine” and then denied drinking any alcohol that day.
Officer N. Colleran administered the horizontal gaze nystagmus test to the defendant during which he observed in both of her eyes lack of smooth pursuit, distinct and sustained nystagmus at maximum deviation and the onset of nystagmus prior to 45 degrees. During the test, the defendant had difficulty following directions and Officer J. Martin noted she moved very slowly and appeared to have a difficult time holding herself upright. The defendant stated she was uncomfortable completing any balance or walking tests.
The defendant initially refused a P. B. T. And was advised she was under arrest for driving while under the influence of alcohol. The defendant then stated she wanted to provide a P. B. T. Which she did and failed. The defendant was again advised she was under arrest for driving while under the influence of alcohol. The defendant submitted to a breath test at approximately 5:45 P.M., which revealed an alcohol concentration of.21. Officer J. Martin spoke with reporting party C. O. Who stated as he was driving past the strip mall on the western side of Shady Oak Road and Main Street intersection the defendant’s vehicle pulled out in front of his, causing him to slam on his brakes and almost come to a complete stop.
