Your complainant is employed by the Columbia Heights Police Department. In that capacity, the complainant has reviewed official reports and has learned substantially the following: On November 6, 2025, at approximately 8:38 P.M., officers were dispatched to the 4600 block of Central Ave NE, Columbia Heights, Anoka County, Minnesota, regarding a report of a male slumped over in a dark-colored Honda Civic (MN plate #[PLATE REDACTED]) stopped in the roadway. Upon arrival, officers observed a male slumped over in the driver’s seat and a young child later identified as the driver’s three year old son, MSLL [DOB REDACTED] seated in the front passenger seat without a child [NAME REDACTED]. After knocking on the window multiple times, officers opened the driver’s side door, observed the driver’s foot on the brake, and placed the vehicle in park before removing the keys from the ignition to prevent operation.
Officers observed several open containers of alcohol, including an open can of beer in the center console and additional containers on the front passenger floorboard near the child. Officers identified the driver as Jose Luis Leon Huaillas [DOB REDACTED], the defendant herein, and detected an odor of alcohol emitting from him. Officer noted Defendant displayed bloodshot and watery eyes. Officers requested the defendant exit the vehicle, and when he did, his child [NAME REDACTED]. Due to cold weather and the defendant’s refusal and resistance to release the child, officers physically removed the child from the defendant’s arms and placed him in the warm squad car.
Despite multiple requests, the defendant refused to submit to field sobriety testing. Officers advised him that he was under arrest, and while attempting to place him in the squad car, the defendant resisted by pushing off the vehicle, stiffening his arms, and extending his legs in front of him on the door frame to prevent placement in the squad car. Officers subsequently used a WRAP to secure him, placed him in the squad car, and transported him to Unity Hospital. Officers applied for and received a warrant for a blood/urine test.
The defendant’s blood was drawn at 11:07 P.M., sealed, and delivered to the BCA for testing. The defendant was then transported to the Anoka County Jail.
