On July 05, 2025, at approximately 7:55 PM, law enforcement was dispatched on a report of an intoxicated driver. Dispatch advised that the complainant reported that the vehicle had driven through the ditch and that the driver appeared intoxicated. Law enforcement located the suspect vehicle near 2nd Avenue, in the city of Cold Spring, county of Stearns, state of Minnesota. Officer Schnell approached the vehicle and identified the driver as Isaiah Paul Johnstone, [DOB REDACTED], the defendant herein.
Officer Schnell observed that the defendant had droopy eyelids, glossy eyes, and was rocking in his seat. While speaking with the defendant, Officer Schnell observed the defendant close his eyes and his head began to tilt back as if he was falling asleep. The defendant continued to have slow movements, slow speech, and appeared to be nodding off. The defendant admitted to smoking marijuana that morning. The defendant performed field sobriety tests and a DRE evaluation, which showed further signs of impairment.
Officers searched the defendant's vehicle and located a small box on the driver's floorboard. Inside the box, law enforcement located a clear container, which contained a pink and white rock substance. The defendant was placed under arrest and a search warrant was obtained for his blood or urine. The defendant was transported to the hospital where two vials of blood were obtained from the defendant. The defendant's blood sample was sent to the BCA for testing. The rock substance was sent the BCA for testing.
On September 08, 2025, law enforcement received a BCA report regarding the testing of defendant's blood sample. The report showed the defendant's blood sample contained fentanyl and norfentanyl, schedule II controlled substances. On December 05, 2025, law enforcement received a BCA report regarding testing done on the pink and white rock substance. The BCA report indicated that the substance had been tested and tested positive as fentanyl, a schedule II controlled substance, with a weight of.599 grams.
Complainant has reason to believe and does believe that all of the above information is true and correct. The above facts constitute your complainant's basis for believing that the above-named defendant on or about the 5th day of July, 2025 in the City of Cold Spring, County of Stearns, State of Minnesota, committed the offense(s) described herein.
