00 AM, the Defendant, who is a tenant in the building, was naked and masturbating in the common area kitchen. The Defendant proceeded to break into another tenant’s bedroom and began masturbating on the bed. There are three bedrooms on that floor of the building. Each tenant on that floor of the building rents a separate individual bedroom. M. C. B., the Defendant and an elderly male tenant each rent a bedroom on the same floor. M. C. B. And the elderly male tenant have padlocks on their bedroom doors.
At 4:00 AM, M. C. B. Went to use the bathroom. The Defendant was still naked in the common area of the residence. He chased M. C. B. Into her bedroom, pushed her on the bed and attempted to touch her breasts over her clothing. He grabbed her throat with both hands and began to choke her. M. C. B. Was able to fight him off and push him out her bedroom door and lock it. Multiple times throughout the night, the Defendant tried to break back into her bedroom by hitting the door with his shoulder. The Defendant told M. C. B. That he had a gun.
Because the Defendant was angry that he could not “get her”, he destroyed the common area kitchen and other areas of the residence causing multiple holes in the walls and door and broke the glass window on the front door of the residence. Damage to the property exceeds $1,000.00. When M. C. B. Left for work, the Defendant was naked and passed out on the floor. When she returned home, the padlock on her door was broken, and she found the Defendant’s phone on her bed. The Defendant was no longer at the residence.
At no time, did M. C. B. Give Defendant permission to enter her bedroom. There is no prior intimate or sexual relationship between the Defendant and M. C. B. The Defendant was high on drugs and intoxicated at the time of the assault. Law enforcement was not able to physically locate the Defendant.
