On November 23, 2025 law enforcement responded for a welfare check on a vehicle that was stopped on the Penn Ave S bridge over Interstate 494 in Richfield, Hennepin County, Minnesota. Law enforcement observed a driver, later identified as Jessica Marie Borgan, [DOB REDACTED] (hereinafter Defendant) sleeping in the driver’s seat with the car in drive. Law enforcement officer’s also noticed burnt tinfoil in her lap. Law enforcement woke the Defendant up and then the Defendant backed her car up in reverse hitting a squad car and then accelerated forward, hitting the squad car in front of her in attempts to flee from law enforcement.
The Defendant was placed under arrest and the Defendant was searched incident to arrest and law enforcement found a tear-off style bag containing a white, rock-like substance on the Defendant. The contents of the bag weighed 0.14 grams and field tested positive for cocaine. Law enforcement conducted field sobriety tests on the Defendant in the Richfield Police Department booking area. No signs of impairment were observed during the Horizontal Gaze Nystagmus. However, law enforcement did note the Defendant had constricted pupils.
The Defendant showed three out of eight impairment clues during the walk and turn test. The Defendant stepped off of the line, used her arms for balance and did an improper turn. The Defendant showed two out of four impairment clues during the one leg stand test. The Defendant used her arms to balance and put her foot down. Law enforcement also conducted the Modified Romberg Test on the Defendant. During the test the Defendant estimated the elapsing of 30 seconds in 36 seconds. Law enforcement also noticed eyelid tremors during the test which is consistent with that of someone under the influence of a controlled substance based on their training and experience.
The Defendant admitted to smoking fentanyl an hour before law enforcement came into contact with her. The Defendant has a prior Controlled Substance Crime in the Fifth-Degree conviction in court file number ••-CR-••-••••. Additionally, the Defendant’s driving record shows that the Defendant has three prior impaired driving- related loss of license due to license revocations pursuant to search warrants on the following dates: 11/28/2024, 01/18/2025 and 04/08/2025.
