Upon arrival at the crash scene, Dep. Peterson observed a blue pickup truck displaying MN/HKZ-849 in the yard of a residence. It appeared the vehicle was traveling westbound before cutting across the eastbound lane, striking a mailbox and road sign, before coming to a rest in the yard of the residence. Dep.
Peterson was approached by the Defendant, who admitted to being the driver of the vehicle. The Defendant stated he nodded off while he was driving, which caused him to leave the roadway and crash into the yard, and that there was “no alcohol involved.” Dep. Peterson observed the Defendant’s speech and movements to be rapid and accelerated, and that his eyes were watery. The Defendant stated the last time he used controlled substances was three months prior. The Defendant consented to a search of his vehicle and Dep.
Peterson located three baggies containing residue that tested positive for methamphetamine, a broken meth pipe, and a hypodermic needle. In addition, it was learned the Defendant’s Minnesota driving status is revoked. Dep. Peterson asked the Defendant to perform field sobriety tests, and the Defendant agreed. The Defendant failed one or more of the tests due to his level of impairment and was taken into custody. The Defendant was transported to Alomere Health, where a search warrant was executed for a sample of the Defendant’s blood.
A.22 caliber long rifle was also located in the Defendant’s vehicle. The Defendant has prior felony drug convictions and is prohibited from possessing firearms or ammunition. PLEASE TAKE NOTICE: Pursuant to Minn. Stat. § 609.49, intentional failure to appear for duly scheduled court appearances may result in additional criminal charges in addition to any arrest warrant that may otherwise be issued by the Court.
