On April 16, 2026, at approximately 9:12 P.M., law enforcement was dispatched to a gas station in Glyndon, Clay County, MN, on a report of a suspected impaired driver. The caller reported seeing a male come into the store who was "obviously impaired" the male was stumbling around and attempted to buy lottery tickets. The caller reported observing the male get back into his vehicle, which had been running. Law enforcement responded and located the described vehicle parked at the store. Officer Amaya observed a male, matching the description from the caller, attempt to get into the driver's side of the still running vehicle.
That male was identified as EDWARD LEWIS BAREE, [DOB redacted], hereinafter "Defendant". Officer Amaya observed Defendant to have poor balance, slurred speech, bloodshot-watery eyes, and that Defendant was unable to speak in full sentences. Officer Amaya could smell a strong odor of alcohol coming from Defendant. At one point, Defendant fell over, and Officer Amaya had to help him get back up. Officer Amaya attempted to administer standardized field sobriety tests, but due to Defendant's inability to perform the first test, Officer Amaya deemed it unsafe to continue.
A preliminary breath test showed Defendant's BAC was.32. Defendant was arrested and brought to the Clay County Jail. At the jail, he was read the breath test advisory and refused to take the test. Defendant had to be transported to detox due to his level of impairment. Defendant has the following impaired driving related offenses for purposes of enhancement: DWI in 2017 in Milwaukee, WI (Case No. 2017ML009743); DWI in 2020 in Ozaukee County WI Circuit Court (Case No. 2019OZ000398); ND license revocation on 2-20-26 for refusing chemical test; ND license revocation on 3- 18-26 for refusing chemical test.
