The Complainant having reviewed the applicable reports believes the following facts to be true: On August 14, 2025 at approximately 11:05 pm, St. Paul police officers responded to the Cub Foods store at [ADDRESS REDACTED] in the city of St. Paul, Ramsey County, to a report of a male slumped over in a vehicle. Upon their arrival they observed a gray 4 door Nissan (MN Lic. Plate # [PLATE REDACTED]) with the motor running and a male, later identified as Adrian Jose Sandoval Calderson ([DOB REDACTED], MN [DL# REDACTED]), defendant herein, sitting in the driver's seat with his head slumped down and his chin was touching his chest.
They then saw that the front of his pants were wet, as it appeared he had urinated on himself. Officers were able to wake up the defendant after a few knocks on the vehicle window. He appeared to be very dazed and confused, looking around but not appearing to comprehend what was going on. While an officer was speaking to the defendant, he did not respond and tried to put the car into drive, but the they were able to stop him from moving the vehicle. Officers had the defendant get out of the vehicle and when he got out, they could see the back of his pants were as wet as the front of his pants.
While the defendant was getting out, he had a hard time balancing on his feet, was stumbling and could not stand up straight. At one point he turned and faced his car, placing both hands onto it to support his weight and keep himself steady. Officers could smell a alcoholic beverage coming from his breath and he was slurring his words. The defendant did very poorly on field sobriety tests, and based on all of their observations officers place him under arrest for DWI. After he was in handcuffs, the defendant volunteered to officers that his wife caught him cheating, so he started to drink and then he got hungry, then drove to the Cub Foods to get food.
Upon a search of his vehicle, officers found a half-empty case of beer. At the LEC, the defendant was read a rights advisory. During this time, the defendant made derogatory comments to the officers, and they could not get him to acknowledge or answer any of the questions from the advisory. When officers asked the defendant if he would like attorney time, he also would not acknowledge the question. When asked if he would take a breath test, he again would not answer the officers, and refused to take the test via his conduct.
