He said he feared the suspects were going to open the window and come into the building. MS said he was scared because he works at McDonalds fulltime. JL told police that he did not see a firearm but based on the male's hand movements and the sound of the firearm slide racking prior, he believed he had a firearm which is why he yelled “gun” before backing away from the drive thru window. JS said one of the males said something like “I'm gonna shoot this bitch up” and to come outside. Based upon the distance of the voices from the intercom, JS thought a passenger made the statement.
During a post-Miranda interview, SOOFE said he did not have a permit to carry. He said the gun was not his and he had never handled it. He said they were ordering food and he told the driver to "drive off" because they did not have something he wanted.
