The vehicle had a driver and one male and one female passenger. After initiating the traffic stop, Deputies observed an odor of alcoholic beverage and marijuana to be emanating from the vehicle, that there was a substance which appeared to be marijuana scattered around portions of the interior of the vehicle, and an open container of alcoholic beverage. A driving while intoxicated investigation was conducted regarding the driver. The two passengers were asked out of the vehicle so that Deputies could conduct a search of the vehicle related to the driving while intoxicated investigation.
When exiting the vehicle, the male passenger took a backpack from the vehicle and put it on the hood of the vehicle. This male passenger identified himself to Deputies as “Robert Burnell Bybee, [DOB REDACTED].” It was later established that the male passenger’s true identify was Uriah Donald Jiminez Bybee, [DOB REDACTED] (Defendant). Deputies observed Defendant to be displaying signs of potential deception in his interactions with Deputies. Deputies searched the backpack in order to investigate whether it contained evidence relevant to the driving while intoxicated investigation.
Deputies located a container within the backpack which contained a 1-dollar bill, a scale, and a baggie containing a substance which appeared to be cocaine. Also located in the backpack was an automatically opening switch blade style knife. The female passenger initially claimed ownership of the backpack but then denied ownership. A debit card with the name “Uriah Bybee” was located in the backpack. Defendant claimed “Uriah Bybee” was his brother and he had permission to have the debit card. Deputies determined that, despite the female passenger’s initial claim of ownership of the backpack, the backpack in fact belonged to Defendant.
This determination was made based on Defendant’s initial possession of the backpack, his deceptive demeanor when interacting with Deputies, and the presence of the “Uriah Bybee” debit card within the backpack. Defendant was then arrested and transported to the Winona County Jail. Deputies were later informed by jail staff that, during the booking process, Defendant provided his correct identity. Deputies later tested and weighed the suspected cocaine. The test revealed a presumptive positive as cocaine and the weight of the cocaine without packaging was 9.5 grams.
