At approximately 8:57 PM, he observed a vehicle fail to signal a right turn and fail to signal a lane change. He therefore initiated a traffic stop near the intersection of HWY 10 and Joplin Street in the City of Elk River, Sherburne County, Minnesota. Deputy Skinner approached the vehicle and identified the driver as JYCENTA LAREE NIELSEN, [DOB REDACTED], the above‐named defendant. The Defendant was the only occupant of the vehicle. Upon approach to the vehicle, Deputy Skinner could see in plain view a clear cannister in the center console, within reach of the Defendant, containing a green leafy substance that he knew from his training and experience to be marijuana.
The Defendant admitted that this was marijuana and that she had more in a container in the backseat. Due to the improperly packaged marijuana, Deputy Skinner searched the Defendant’s vehicle. On the passenger seat of the vehicle, Deputy Skinner found a clear plastic tote. The tote contained a small black zip‐style makeup‐type bag. There was a pink plastic container inside of the bag. A glass bubble pipe with residue consistent with methamphetamine and a small glass vial containing a white crystal‐like substance was Inside the pink plastic container.
The crystal‐like substance field‐tested positive for methamphetamine and it was later determined that the substance weighed 0.87 grams, without packaging. Methamphetamine is a Schedule II Controlled Substance. PLEASE TAKE NOTICE: Pursuant to Minn.
