That your complainant is a peace officer employed by the Minnesota State Patrol who was advised of the following by a law enforcement officer with that agency, known to your complainant to be truthful and reliable and who is hereinafter referred to as officer: On 11/5/2025, at approximately 10:14 P.M., while in the City of Rochester, Olmsted County, State of Minnesota, a Minnesota State Trooper observed a motor vehicle bearing Minnesota license plate number ZLM218 driving visually fast, fail to use a turn signal, commit a stop sign violation, and weave between lane lines crossing into the wrong direction of traffic.
The trooper confirmed the vehicle speed using radar at 56 miles per hour in the 45 mile per hour zone. The driver admitted to consuming alcohol prior to driving, and that he had recently left a bar. The driver was identified as Zachary John Hayes, [DOB REDACTED], the Defendant herein, and was observed to have breath with an odor of an alcoholic beverage, bloodshot, and failed to correctly perform field sobriety tests, including failing a PBT (with a result of 0.26). The Defendant was placed under arrest for driving/operating/being in physical control of a motor vehicle while under the influence of alcohol.
Upon being read the Breath Test Advisory at 11:02 P.M., and after being advised of the right to speak to an attorney, the defendant consented to take the offered breath test. The defendant’s alcohol concentration was 0.26 at 11:20 P.M. PLEASE TAKE NOTICE: YOU MUST APPEAR FOR EVERY COURT HEARING REGARDING THIS CASE. FAILURE TO APPEAR FOR COURT IS A CRIMINAL OFFENSE AND MAY RESULT IN ADDITIONAL CRIMINAL CHARGES BEING IMPOSED AND PUNISHED AS PROVIDED IN MINNESOTA STATUTES SECTION 609.49.
