At approximately 12:15 AM on March 30, 2026, Officer Miranda of the Chaska Police Department was conducting speed enforcement on Highway 41 near its intersection with 1st Street in the City of Chaska, Carver County. At that time he observed a vehicle traveling visually fast, which he then confirmed via squad radar to be driving 46 miles per hour in a posted 30 mile per hour zone. Officer Miranda initiated a traffic stop and identified the driver of the vehicle to be Michael Keith Schwalbe [DOB REDACTED], hereinafter Defendant.
Defendant’s eyes were bloodshot and watery. Defendant’s pupils were constricted and Officer Miranda observed a white powdery substance on Defendant’s nostril. Defendant was unable to provide his ID or proof of insurance. Defendant agreed to perform field sobriety tests. Defendant’s performance on the HGN Test indicated impairment. Defendant estimated the passage of 30 second at 21 seconds during the Modified Romberg Test; Defendant exhibited fast eyelid tremors during this test. Defendant’s performance on the Walk and Turn Test indicated impairment.
Defendant did not exhibit clues on the One Leg Stand Test. Defendant provided a preliminary breath sample that resulted in a reading of.000. Defendant was placed under arrest. Defendant indicated he had a baggie of methamphetamine in his pocket, which was subsequently located and weighed 2.8 grams and field tested positive as methamphetamine. Officer Bengtson conducted an inventory search of Defendant’s vehicle and located a loaded syringe in the glovebox and an open bottle of vodka behind the passenger seat.
Defendant was taken to the 212 Medical Center and a search warrant was obtained for Defendant’s Blood or Urine. Defendant agreed to provide a blood sample. Defendant later admitted to using methamphetamine the day prior. Defendant has at least three prior DWI related offenses falling outside the 10-year lookback provision.
