O. B. 06/13/1993, hereinafter "Defendant," had arrived at the Minnesota Correctional Facility, in Saint Cloud, Sherburne County, Minnesota, for intake. Defendant spoke to the nurse and reported that he was experiencing withdrawal. He had last used Fentanyl two days ago and was feeling restless and anxious. Defendant was rocking back and forth during the intake screening. The Defendant was subsequently moved to Segregation on Withdrawal Protocol Status. As part of that process, a unclothed body search of Defendant was conducted.
While performing the search, staff noticed an item halfway out of Defendant's rectum. Defendant eventually complied with commands to remove the item. Staff noted that the item was a small clear baggie containing an unknown white powder. Defendant admitted that the baggie contained fentanyl. The white powder was field‐tested and came back positive for fentanyl. On March 29, 2024, Investigator Michael Vandevord, with the Minnesota Department of Corrections, spoke to Defendant. Defendant explained that he had been housed at the Stearns County Jail before being transferred to MCF‐Saint Cloud.
Defendant admitted that he had brought about half a gram of fentanyl into the facility by concealing it in his rectum. Defendant had the fentanyl on him when he was initially arrested. On April 5, 2024, Investigator Vandevord submitted the baggie of suspected fentanyl to the Midwest Regional Forensic Laboratory for further testing. On May 8, 2024, the results came back from the Midwest Regional Forensic Laboratory. The substance weighed 0.251 grams + or ‐ 0.006 grams and contained fentanyl. Fentanyl is a Schedule II controlled substance.
