On or about December 1, 2025 at approximately 9:45 PM, Deputy Mirovksy of the Washington County Sheriff's Office was dispatched on report of an unwanted person at the Holiday Stationstore located at [ADDRESS REDACTED] N in the City of Lake Elmo, Washington County, Minnesota. The deputy was advised that the unwanted person, identified as ALEX ROBERT EMMONS d/o/b, was refusing to leave and making employees uncomfortable. The deputy was advised that Defendant got into a Subaru Impreza in the parking lot.
Upon arrival, the officer observed Defendant reverse out of a parking space in the lot. The deputy activated their emergency lights and stopped the vehicle. The deputy identified the driver as Defendant. Upon contact, the deputy detected the odor of consumed alcohol emanating from Defendant's breath. The deputy observed that Defendant's eyes were glazed and watery, and he spoke with slightly slurred speech. The deputy administered standardized field sobriety tests, during which Defendant performed poorly.
Defendant agreed to submit to a PBT, which yielded a sample of 0.213. Defendant was placed under arrest and transported to the Washington County Jail. Deputy Palmer spoke with store employees I. K. And B. A. I. K. Advised that he called in because Defendant was bothering B. A. B. A. Stated that Defendant asked her for her phone number. B. A. Advised that she told Defendant he could not have her phone number and inquired if he needed assistance with anything else. B. A. Stated that Defendant left the store, but came back shortly thereafter and told her he broke her heart.
B. A. Began apologizing and Defendant then told her that she could fix the problem, at which point I. K. Stepped in and told Defendant to leave the store. B. A. Advised that Defendant appeared to be under the influence of alcohol. I. K. Advised Defendant was slow to respond and acted "off." Defendant was read the Minnesota Breath Test Advisory and ultimately refused to submit to a DMT breath test. During a search of the vehicle prior to tow, law enforcement located an open and half full 20 ounce White Claw hard seltzer can in an Arby's food bag in the front seat.
Multiple unopen cans of the seltzer as well as small bottles of Tito's vodka were also located in the vehicle. A review of Defendant's criminal history does not show any prior qualified impaired driving convictions.
