The Complainant having reviewed the applicable reports believes the following facts to be true: On August 2, 2024 at approximately 9:59 pm, a Minnesota State Patrol trooper was dispatched to westbound I94 and Ruth street in the City of St. Paul, Ramsey county, to a report of a vehicle on fire. The trooper arrived on scene at 10:05 and observed a silver SUV (MN Lic. Plate No. LWY495) on the right shoulder of westbound I94 at Ruth street. There were no visible flames or smoke coming from the vehicle.
The trooper approached the passenger side of the vehicle and observed a female sitting in the driver's seat, identified as Sinoun Lorittea War (DOB 10.29.1973, MN Driver's Lic. No. A901093073610), defendant herein. While speaking with her the trooper observed she had slightly bloodshot watery eyes, and began to smell a moderate odor of a consumed alcoholic beverage coming from her. The trooper had her step to the front of the squad car for further investigation and she was hesitant and stated "Now you're going to do the intoxication?" The trooper explained that they were suspecting possible intoxication and asked when she last had a drink of alcohol.
She replied two and a half hours ago and stated she had drunk "crown" straight with no mixer. The trooper had the defendant perform standard field sobriety tests. The defendant did poorly on the tests and was placed under arrest for DWI at approximately 10:28pm and transported her to the LEC. After arriving at 11:03 pm.the trooper read the breath test advisory to the defendant. When asked if she wanted to consult with an attorney she said no. When asked if she would take a breath test, she said "no, why would I do that, I already told you I've been drinking." The trooper reminded her that refusal to provide a breath test as a crime and again asked her if she would take the breath test and she replied "sure." The result of the DMT breath test was a.22 at 11:21 PM. Defendant has a prior DWI conviction from 2016. Pursuant to the requirements of Minnesota Statues Sections 169A.40 and 169A.44, a warrant is requested.
