On November 6, 2025, at approximately 12:34 AM, Officer Hulshizer with the Rochester Police Department was on patrol on Highway 52 northbound in Rochester, Olmsted County, MN. At that time, he observed a vehicle (MN RDE444) also driving northbound on Highway 52. The driver of the vehicle had his cell phone in his hand and it was illuminated, indicating that the driver was unlawfully using the device while in control of the motor vehicle. Ofc. Hulshizer initiated a traffic stop. The driver of the vehicle was identified as KIP MICHAEL LEVOS [DOB REDACTED]. Levos admitted to using his phone while driving.
While speaking to Levos, Ofc. Hulshizer noticed an odor of burnt marijuana coming from the vehicle. Levos also displayed numerous signs of intoxication, including irritability, bloodshot and watery eyes, and constricted pupils in dark lighting. Levos admitted that he had marijuana in the vehicle and that he had smoked it "a while ago." The marijuana was not in its original sealed packaging. Based on this information, a vehicle search was conducted. Prior to the search, Levos spontaneously said there was "14 grams of meth" in the vehicle.
A search was conducted and 18.4 grams of presumptively positive methamphetamine was found in the vehicle. Levos was placed under arrest and transported to the Olmsted County Adult Detention Center. Based on the presence of methamphetamine in the vehicle, the admission of marijuana use, and the indicia of intoxication, Ofc. Hulshizer asked Levos to perform field sobriety testing. Levos refused. A search warrant was then obtained for a sample of Levos' blood or urine. Levos also refused to provide a sample of his blood or urine.
