On or about November 2, 2025, at approximately, 1:30 A.M., a Minnesota State Trooper was on patrol when he observed a vehicle enter the highway at a high rate of speed and immediately getting into the left lane after getting off the ramp. The trooper caught up to the vehicle and locked in a speed reading of 77 mph in a 60‐mph zone. The vehicle also switched from the left lane into the center lane without utilizing its turn signal. The trooper conducted a traffic stop on the vehicle, and the vehicle pulled over at I‐35W and Industrial Boulevard, in the City of Minneapolis, County of Hennepin, State of Minnesota.
The trooper approached on the driver’s side and observed a male in the driver’s seat, later identified as Ismael Arellano [DOB REDACTED], Defendant herein. Checks revealed that Defendant’s driving privileges were canceled inimical to public safety. The trooper observed that the occupants of the vehicle had on 21+ wristbands. The trooper smelled the odor of consumed alcohol emanating from the cabin of the vehicle, and the trooper observed Defendant’s eyes were bloodshot and watery. The trooper asked Defendant how much he had to drink that evening, and he indicated, “not much.” Defendant indicated he had two drinks.
The trooper observed a red solo cup in the cup holder of the vehicle. The trooper asked Defendant what was inside, and Defendant indicated nothing. When the trooper asked to check, Defendant spilled the contents of the red solo cup on himself. Defendant showed the trooper the empty cup, which the trooper noted smelled like alcohol. Defendant was asked to submit to field sobriety tests. During these tests, the trooper observed clues of impairment. Defendant provided a breath sample for the preliminary breath test (PBT), which showed an alcohol concentration of 0.169. Defendant was placed under arrest for DWI. Defendant was transported to Hennepin County Jail.
The trooper read the Motor Vehicle Breath Test Advisory to Defendant. Defendant elected to use his attorney time. When Defendant was first asked to take the breath test, Defendant refused. Defendant then agreed to take the breath test. At 3:09 A.M., Defendant provided a breath test that revealed an alcohol concentration of 0.16.
