Officer parked near Vehicle without blocking Vehicle. Officer observed an adult male sleeping in the driver’s seat of Vehicle. Officer knocked on the window of Vehicle to check on the welfare of the driver. Based on previous professional contacts, Officer recognized the driver as Marty Todd Haley, [DOB REDACTED] (“Defendant”). When Defendant opened the door, Officer immediately detected the odor of consumed alcoholic beverages from inside Vehicle. Defendant turned off Vehicle, and exited Vehicle without being asked.
Defendant told Officer he had consumed a couple of beers earlier. Officer had Defendant perform standardized field sobriety tests. Officer administered the HGN test and observed lack of smooth pursuit in both eyes, distinct and sustained Nystagmus at maximum deviation and Onset of Nystagmus prior to a 45 degree angle. Defendant performed the Walk and Turn test and made an improper turn. Defendant performed the One Leg Stand test and used his arms for balance, swayed for balance and hopped. Officer gave Defendant a PBT, which showed 0.041% BAC. Officer was informed by dispatch that Defendant had a restricted driver’s license and that any use of drugs or alcohol invalidates the license.
Defendant also had an ignition interlock restriction. Defendant admitted there was no ignition interlock in Vehicle. Defendant also admitted he could not be in control of a motor vehicle after consuming drugs or alcohol. Defendant was placed under arrest and put in handcuffs. During a search incident to arrest Officer located a baggie in Defendant’s front left pants pocket that contained a white crystal-like substance that appeared to be methamphetamine. The white substance field tested positive for methamphetamine and weighed without packaging 1.3 grams. 3 ••-CR-••-•••• Filed in District Court State of Minnesota 2/27/2026 Defendant was transported to the Winona County Jail without incident.
