M., Big Lake Officer Michael Asfeld was dispatched to a domestic assault in the city of Big Lake. The initial dispatch location was at the address of [ADDRESS REDACTED]. The caller’s phone last pinged in the area of Highway 10 and County Road 17. Officer Asfeld noticed a 2017 Acura SUV near County Road 81, MN Lic KJV412, the lone vehicle stopped on a rear access road. Officer Asfeld ran the registration on the vehicle and found that the vehicle’s registered owner’s address is the initial address reported for the domestic assault.
Officer Asfeld followed the vehicle as it proceeded toward the stop sign off of County Road 81. The vehicle failed to make a complete stop at the stop sign. As the driver turned northbound, Officer Asfeld did not observe a turn signal. The vehicle accelerated rapidly and was unable to maintain consistent speed. Officer Asfeld saw the back right passenger wave a hand out the window. Officer Asfeld activated his emergency lights to stop the vehicle. The back passenger, JMF, stated that he was the party that called 911. JMF said that his three year old child was in the rear passenger seat.
The front passenger, JEFS, indicated that the argument was all verbal. The driver was identified as Fernanda Antonia Fragoso Aguilar, [DOB REDACTED], hereinafter referred to as the defendant. The defendant indicated that the men in the vehicle were in an argument. While speaking with the defendant, Officer Asfeld could smell the odor of an alcoholic beverage coming from the defendant. She had red, glassy eyes. The braced herself on the bumper of the squad car. She acknowledged that she had one alcoholic beverage four hours ago.
The defendant failed the Horizontal Gaze Nystagmus test. She took a preliminary breath test, which registered as.178. Officer Asfeld obtained a search warrant for the defendant’s blood or urine. She was transported to the Monticello Hospital and provided a sample as of 12:39 A.M. PLEASE TAKE NOTICE: Pursuant to Minn.
