On January 6, 2026, at 0115, Shakopee Police Officers were on patrol near the Speedway Store lot, 12th Ave and Disc Dr., Shakopee, Scott County, Minnesota, when the officer ran a check on a 2002 silver Buick Century bearing Minnesota license plate [PLATE REDACTED], which showed the registered owner, TAC, [DOB REDACTED], to have a revoked driving status. The officer saw a female, younger than the registered owner exit the vehicle and enter the store. The officer saw a Yolanda Garcia Guerra, [DOB REDACTED], hereinafter the Defendant, also residing at the same address as TAC. A short time later, the officer saw the Defendant leave the parking lot in the vehicle and begin traveling westbound on 12th Avenue E and failed to use their right turn signal.
The officer caught up to the vehicle which abruptly changed from the left turn only lane to the westbound lane. After crossing over County Road 83, the officer saw the vehicle begin drifting to the right and partially hit a snowbank. The officer saw the Defendant moving around in the vehicle. The Defendant was positively identified and admitted she did not have a license. The officer saw the Defendant had jerky motions and could not sit still. The Defendant had a fast speech pattern and would rarely maintain eye contact with the officer.
The officer had the Defendants exit the vehicle. The Defendant denied being under the influence of anything. The officer had the Defendant perform field sobriety tests, which she failed. The Defendant was arrested for DWI. The Defendant's person was searched and the officer found a butane torch. The officer had a Eden Prairie Officer and his K9 narcotics dog come to the scene. A short time later, the K9 positively alerted to the vehicle. Officer searched the vehicle and found: A clutch type of wallet that contained a bubble pipe with white residue.
Also in the wallet was a clear plastic baggie with a white/clear crystalline substance, which field tested positive for methamphetamine, a Schedule II Controlled Substance, and weighed.908 grams. The Defendant had muttered something to the effect that she was going to refuse testing. The Defendant was taken to the St. Francis Hospital. The officer drafted a search warrant for a sample of the Defendant's blood/urine. The warrant was signed by Judge Webber at 0248. The Defendant refused to provide a sample of her blood or a sample of her urine, constituting a refusal.
The Defendant was taken to the Scott County Jail. During intake process, corrections officers located a crystalline substance that had been concealed in a dollar bill. The substance field tested positive for methamphetamine, a Schedule II Controlled Substance, and weighed.058 grams. The Defendant spontaneously uttered during this time that she forgot she had that in her possession. The total amount of methamphetamine found was 1.48 grams. A check of state records showed that the Defendant had a prior impaired loss of license within the past 10 years: 05/18/2025 DWI Wright 86CR254198(Pending) 08/04/2025 Revoked DWI.
