M., a Winona County Sheriff's Deputy ("Deputy") was dispatched to a residence in Minnesota City, Winona County, Minnesota, for a disturbance. Dispatch reported while they were on the phone with the reporting party ("Victim") they could hear a male in the background yelling. Upon arrival at the scene, Deputy walked up to the front door and knocked. Victim [NAME REDACTED]. As Victim [NAME REDACTED], Deputy observed an abrasion on Victim's left forearm where skin had been peeled up, a small smear of blood on her left cheek, and red marks on the right side ofVictim's neck and bottom ofher throat.
Victim stated she and her husband, Brian Randall Zachary, [DOB REDACTED] ("Defendant"), have been having marital problems. Victim stated they have been married for 15 years and have children together. Victim [NAME REDACTED] had come over to drop off their son's baseball equipment and Defendant asked to speak to her. Victim stated she came out of the house and opened the passenger side door of Defendant's truck and asked him what he wanted to talk about. Victim [NAME REDACTED] into an argument and Defendant put his truck in reverse while she was standing just behind the passenger side door.
Victim [NAME REDACTED] was trying to run her over, so she jumped into the passenger seat to avoid getting hit by the door. Victim [NAME REDACTED] is how her arm was injured. Deputy asked Victim [NAME REDACTED] on her neck and Victim was evasive with her answer but then stated it was from stress. Deputy told Victim the marks appeared to be from a hand and someone grabbing her neck. Victim [NAME REDACTED] was video of the incident outside. Deputy watched the video. Deputy observed a person behind the front passenger side door and Victim [NAME REDACTED]. Deputy then observed the vehicle was put into reverse and it showed Victim jumping into the passenger side of the vehicle.
Victim reported Defendant's demeanor had changed and he had been gaslighting Victim and making her second guess everything she did. Victim stated Defendant: 3::: was psychologically/mentally abusing her and there had been incidents of physical abuse in the past that Victim [NAME REDACTED]. PLEASE TAKE NOTICE: Pursuant to Minn. Stat. 609.49., intentional failure to appear for duly scheduled court appearances may result in additional criminal charges, and in addition to any arrest warrant that may otherwise be issued by the Court.
