In court file 62-K5-01-002028, CALVIN DEVON GILLMORE, [DOB REDACTED], was convicted of felony VOCSL 5th Degree, conviction date 2/8/2002 (alias Christopher Williams). GILLMORE is prohibited from possessing firearms and ammunition. On December 23, 2025, at approximately 7:43 P.M., Saint Paul Officers stopped a 2013 black Nissan Armada that was observed swerving over the white traffic line and within the lane northbound on Robert Street, Saint Paul, County of Ramsey. Officer Kindom activated squad emergency lights and initiated a traffic stop near the intersection of Kellogg Boulevard and Sibley Street.
GILLMORE was the driver. GILLMORE smelled of alcohol. Officer Kindom observed an alcohol bottle on the center console. Upon inquiry, GILLMORE said he had one shot. GILLMORE was asked to exit the vehicle. Field sobriety tests were conducted. During the tests, clues of impairment were noted to include lack of smooth pursuit in both eyes, distinct nystagmus at maximum deviation in both eyes, used arms to balance, turned improperly, and took the wrong number of steps. GILLMORE was arrested for DWI. During the search of the vehicle, a nearly empty bottle of Don Julio Tequila Reposado was found in the center console.
A black bag with a silver container with multiple individual baggies of suspected marijuana was also found. A black handgun-Springfield Xd 9mm-loaded with magazine and ammunition- was also found in the center console. A loose round was also recovered. GILLMORE was transported to the jail. At 8:14 P.M., the Breath Test Advisory was read to him. GILLMORE was given attorney time. GILLMORE refused to take the breath test, and said, “Because I’ve had a shot and I don’t want that thing to say I’m drunk.” Officer Tillett completed and obtained a search warrant for GILLMORE’s DNA. Officer Tillett executed the search warrant and obtained a sample of GILLMORE’s DNA. After a Miranda advisory, GILLMORE spoke with Sgt.
Welters. GILLMORE said he was driving from his residence off of Wood Street, turned onto Robert Street, and was stopped by officers on Kellogg Boulevard. GILLMORE said he was not intoxicated. GILLMORE said he owned the vehicle for about four years. The car was in his and his girlfriend’s name. GILLMORE said that only he and his girlfriend drive the vehicle. GILLMORE said the bottle of alcohol in the car had been empty for about three days. GILLMORE denied knowing anything about the gun found in his car.
When advised that his DNA would be on the gun if he handled it, GILLMORE’s demeanor changed. He looked around the interview room and hesitated when answering questions.
