On December 20, 2025, at about 5:50 P.M., Officer Fitzgerald of the Rochester Police Department was dispatched to a report of a possible slumper at the intersection of 12th Street and 5th Avenue Southeast, Rochester, Olmsted County, Minnesota. Upon arrival, Officer Fitzgerald observed a vehicle that was parked in a manner that obstructed the intersection with a single occupant seated in the driver’s seat. Officer Fitzgerald recognized the occupant as Corey Jay Gilbertson [DOB REDACTED] from prior law enforcement contacts.
Officer Fitzgerald observed Gilbertson was unconscious in the driver’s seat with drool protruding from his lower lip and his body was positioned in a bent-forward posture leaning toward the steering wheel. In plain view, on the driver’s side floorboard, Officer Fitzgerald observed multiple items of suspected drug paraphernalia including a glass smoking device commonly used for smoking methamphetamine. Inside the glass device, Officer Fitzgerald observed a white crystal like substance. Officer Fitzgerald attempted to wake Gilbertson, who appeared extremely lethargic and made incoherent verbal statements.
Gilbertson’s speech was slurred and slow and he was unable to remain awake. His eyes were bloodshot. Due to his inability to remain conscious or follow verbal commands, Gilbertson was assisted out of the vehicle and carried to ambulance and taken to the hospital. Officer Fitzgerald did not administer standardized field sobriety tests. Officer Fitzgerald confirmed Gilbertson’s driver’s license was canceled as inimical to public safety. His driver’s license records shows notice of cancel and deny date 09/15/2025. Officer Fitzgerald obtained a search warrant for Gilbertson’s blood or urine.
Officer Fitzgerald explained the contents of the search warrant to Gilbertson. Gilbertson was noncompliant. He was thrashing his arms and legs. Officer Fitzgerald was unable to safely obtain blood or urine sample from Gilbertson. 3 55-CR-25-9783 Filed in District Court State of Minnesota 12/23/2025 Gilbertson was previously convicted of driving while impaired: On 09/21/2021, Court File Number 20-CR-20-576 On 07/18/2018, Court File Number 74-CR-17-2070 Gilbertson’s driver’s license was also revoked pursuant to search warrant related to driving while impaired on 07/19/2025 and again on 06/27/2025.
