On November 1 2025, at approximately 0413 hours, Dep. Willey of the Olmsted County Sheriff's Office located a traffic accident near the 5000 block of 48th Street NE, in the Township of Haverhill. Willey observed two males standing in the roadway. Willey identified the males, one of which identified as defendant herein, Bakil Nuh Dahir [DOB REDACTED]. Willey noted that he could smell the odor of alcohol emitting from both, and noted that they had bloodshot eyes. The males stated that they did not want Willey’s assistance, and that they would handle the accident themselves.
Their vehicle had moderate damage, with both curtain airbags deployed, passenger side damage, and a broken windshield. The vehicle had grass stuck in the rear passenger tire, front driver’s tire, bumper, and driver’s side pillar and windshield. Willey observed tire marks in the north ditch that appeared consistent with the damage to the vehicle. Defendant admitted to being the driver. Defendant asked Willey to leave and both males denied to provide identification, initially, stating that they believed he didn’t need them.
Willey informed them that he needed their identification due to the severity of the accident. Defendant claimed the accident was the result of swerving to avoid a deer or squirrel. Willey asked Defendant if he had consumed any alcohol prior to driving, to which defendant responded that he’d had two shots of alcohol approximately an hour before the accident. Defendant stated that he was, on a scale of 1 to 10, at a level 3 of intoxication. Willey conducted standardized field sobriety tests. Willey noted a moderate odor of alcohol, staggering, lack of smooth pursuit in horizontal gaze nystagmus testing and other clues of impairment during SFSTs. Defendant’s passenger complained of pain in his right leg.
The passenger had scrapes on his left hand and right forearm. The passenger was dropped of at his residence, and Dep. Klaysmat noted that he limped while walking, especially up or down stairs. Defendant provided a preliminary breath test, which indicated that defendant’s BAC was.086. A search warrant was obtained for Defendant’s blood. Sgt. Wagner performed a blood draw and collected a sample for testing. PLEASE TAKE NOTICE: YOU MUST APPEAR FOR EVERY COURT HEARING REGARDING THIS CASE. FAILURE TO APPEAR FOR COURT IS A CRIMINAL OFFENSE AND MAY RESULT IN ADDITIONAL CRIMINAL CHARGES BEING IMPOSED AND PUNISHED AS PROVIDED IN MINNESOTA STATUTES SECTION 609.49.
