04 am, Douglas County Sheriff’s Deputies responded to a report of a burglary in progress at a residence in Douglas County, Minnesota. T. K. Reported a male broke into their house and there was a physical altercation. Upon arrival, Dep. Herzberg observed a vehicle parked outside the home, which was later determined to belong to LEVI CARTER HELLAND, [DOB REDACTED] (“Defendant”). As he walked up to the house, Dep. Herzberg observed the Defendant being placed into custody by Dep. Leverington. Dep. Herzberg spoke to the homeowner, D. V., and other family members and witnesses who were present during the altercation.
In total, there were five individuals inside the residence when the burglary occurred. D. V. Stated that just prior to calling 911, he was walking from the living room into the kitchen when he heard someone enter the residence through an unlocked door behind him. D. V. Initially thought it was a friend of one of his kids. However, the individual, later identified as the Defendant, followed him into the kitchen and sat down next to a dog kennel. The Defendant began speaking of someone named Cheyenne, who D. V. Was not familiar with.
The Defendant was told to leave numerous times and refused to do so. D. V. Called 911 and then told the Defendant to stay put until the sheriff arrived. The Defendant then got up and approached D. V. And began swinging at him. D. V. Took the Defendant to the ground and put him in a headlock until he calmed down. D. V. Loosened his grip on the Defendant and the Defendant turned on his back and began throwing punches at D. V. The incident was captured on video by at least two witnesses. While speaking with D. V., Dep.
Herzberg observed he was out of breath and had several red marks on his face. The Defendant is currently on Intensive Supervised Release (parole) for 3rd Degree Criminal Sexual Conduct.
