M., Investigator Michele Vlasak, of the Sherburne County Sheriff's Office, received a call from the Sherburne County Jail, located in the city of Elk River, Sherburne County, Minnesota, regarding some narcotics that had been located. Investigator Vlasak arrived on scene and spoke to the jail staff. He learned that staff had conducted a random search of the Gamma 120 cell, which is the cell that ALEJANDRO CERVANTES, [DOB REDACTED], hereinafter "Defendant," is housed in. When staff arrived to conduct the search, they heard, and saw, Defendant and his cellmate rapidly and continuously flushing the toilet.
The trap for the cell's drain system was searched, and multiple small bags containing a white substance were located. Staff elected to perform a strip search of Defendant. During that search, staff noticed something sticking out from Defendant's anus. Defendant was instructed to remove the item. Defendant complied, and pulled out two pieces of clear plastic with a white powder wrapped inside. A NIK test was performed on the substance recovered from Defendant's anus. It tested positive for the presence of methamphetamine.
The substance was then sent off to the Midwest Regional Forensic Laboratory for further testing. Investigator Vlasak received the results from the Midwest Regional Forensic Laboratory. One item weighed 0.488 grams + / ‐ 0.0005 grams and contained methamphetamine. The other item weighed 0.027 grams +/‐ 0.005 grams and contained methamphetamine, for a total weight of 0.515 grams.
