Complainant is Minnesota State Patrol Lieutenant John Fritz. Complainant states that on March 4, 2023, at approximately 7:46pm, troopers conducted a traffic stop in the area of Bass Lake Road in the city of Maple Grove, Hennepin County, Minnesota, due to the vehicle's speed being measured at 85 MPH in a 60 MPH zone. Upon contact with the driver, later identified as TREVOR ALEXANDER PAETH [DOB REDACTED], PAETH stated he though he was going 79 MPH. When speaking with PAETH, troopers detected a strong odor of alcohol coming from inside the vehicle.
Troopers also observed PAETH's eyes were bloodshot, watery, and glassy. Troopers advised PAETH it was obvious he had been drinking and asked PAETH how much he had, to which PAETH admitted to having 2 16oz beers prior to driving. Troopers requested PAETH to exit the vehicle to participate in Standardized Field Sobriety Tests (SFSTs). Upon exiting the vehicle, toopers observed the strong odor of alcohol coming from PAETH's person and breath. During SFSTs, troopers observed PAETH to have lack of smooth pursuit in both eyes, distinct and sustained nystagmus at maximum deviation in both eyes, and onset of nystagmus prior to 45 degrees in both eyes during the HGN portion.
During the one-leg-stand test, troopers observed PAETH to be swaying and using his arms for balance, as well as PAETH needing to put his foot down three times to regain balance. During the walk-and-turn test, PAETH was observed stepping off the line and making an improper turn despite being instructed on how to properly turn. PAETH gave a PBT sample of.151 BAC. PAETH was placed under arrest and was transported to the Hennepin County Jail where he was read a Breath Test Advisory. PAETH agreed to give a DMT sample, which registered at.17 BAC at 9:00pm, within two hours of his driving conduct.
