On December 24, 2025 around 11:34 P.M. Chaska Officers responded to Kwik Trip in Chaska, Carver County, after a report of an intoxicated male pumping gas and getting ready to leave. The Kwik Trip employee G. B. Stated the car was a dark Chevrolet Impala at pump 12 and the man had dreadlocks and was wearing a navy hoodie. Officers arrived and observed a gray Impala. The driver’s side door was open, the headlights were on, and the vehicle was running. A man was leaning against the car swaying. Officers later identified the man as Xavier Willie Hines (12-2-2000), hereinafter defendant.
Officers approached and Defendant stated he was experiencing issues with the gas pump. Defendant had difficulty standing. Defendant reacted slowly, had slurred speech, was difficult to understand, and repeatedly scratched his nose. When asked about use Defendant stated he used marijuana earlier that day. Defendant denied alcohol or hard drug use. Defendant continued to scratch his nose and had unusual jaw movements and frequently closed his eyes. Defendant refused field sobriety tests. Defendant was transported to the Carver County Jail.
During a search incident to arrest two aluminum foils with burnt resident were located on his person. There was a small white bag containing a white powdery substance in his pants pocket. Defendant was nearly falling over and officers assisted him. Defendant was transported to the jail. The suspected drugs tested positive for cocaine and weighed.45 grams including the baggie. Defendant agreed to field tests and a DRE test at 212 medical center. Defendant performed poorly, estimating 30 seconds on the passage of 52 seconds on the modified Romberg test, swaying and losing balance on the one leg stand and refusing the walk and turn.
A PBT was.00. A Blood draw was taken and results were sent to BCA for testing. On December 3, 2024 Defendnat was convicted in McLeod County Court File ••-CR-••-•••• of driving while impaired.
