Officer Rethwill arrived and spoke with KX who said DAVIS is his brother’s friend.
DAVIS was invited to stay overnight at their home. KX confronted DAVIS about some missing items and damage to the garage door at their apartment complex. He and DAVIS got into a verbal altercation. DAVIS went after him and put him in a chokehold. While he was in the chokehold, his vision was dim. His brother pleaded with DAVIS to stop choking him. KX said while he was choked, DAVIS picked him up and slammed him to the floor, bruising his toes. KX’s brother, JV, said he knew DAVIS from a homeless encampment.
He invited DAVIS to spend the night to sleep on the floor. KX and DAVIS got into an argument about missing items and damage to the garage door. KX and DAVIS argued back and forth. DAVIS attacked KX and placed him in an “HO” hold. He pleaded with DAVIS to release KX and was worried that DAVIS would seriously hurt him. KX had marks on his neck-bruising and redness on the left, center, and right sides of his neck. DAVIS said he and KX were going back and forth. KX tried to go at him so he wrapped him up over his shoulders.
He and KX argued about eating KX’s food and the damage to the garage door. DAVIS was arrested. After a Miranda advisory, DAVIS spoke to Officer Rethwill. DAVIS denied assaulting anyone. He said he only wrapped up KX. While DAVIS was seated in the back seat of the squad car, he tried to free himself multiple times. During the transport, DAVIS removed the seatbelt, thrashed around, and tried to wrap the seatbelt around himself. Officer Rethwill pulled the squad car over on Highway 36 while another officer tried to secure DAVIS. During the continued transport to the jail, DAVIS tried to pull the seatbelt and manipulated the doors, trying to free himself.
