Deputy Gregory Antigua noted that one of the suspect vehicles had expired registration. While traveling eastbound on Highway 10 in Sherburne County State of Minnesota, Deputy Antigua observed the two vehicles. The deputy turned around and observed the vehicles begin to accelerate as he attempted to catch up with them. The vehicles then turned onto 97th Street SE and began traveling back eastbound and again accelerated at a high rate of speed. When the deputy caught up with the vehicles one of them turned northbound and the vehicle with expired registration turned southbound.
The deputy initiated a traffic stop of the vehicle with expired registration and made contact with the driver and sole occupant of the vehicle, identified as NICHOLAS XAVIER STONE [DOB REDACTED], defendant herein. While speaking with the defendant the deputy observed the defendant to exhibiting signs consistent with recent drug use, including pinpoint pupils, slow speech, slow eye movements and sluggish movement. The deputy also observed items consistent with drug use in plain view in the vehicle, including a butane torch on the passenger seat, burnt and folded tinfoil on the seat and floor and a burned glass pipe on the floorboard.
The defendant showed a revoked [DL# REDACTED] which was confirmed by the defendant. The defendant admitted to using fentanyl and suboxone within the last three months. A search of the vehicle resulted in the discovery of a used syringe and a clear plastic baggie with white powdery residue consistent with methamphetamine in a black backpack that the defendant claimed was his. The defendant consented to a search of his person, which resulted in the discovery of a large plastic baggie containing two smaller baggies in his right shoe.
The defendant advised the deputy the substances were fentanyl and methamphetamine. One of the baggies contained a purple powder substance that subsequently field tested positive for the presence of fentanyl and weighed 1.39 grams with packaging. The other baggie contained a white powdery substance that subsequently field tested positive for the presence of methamphetamine and weighed 1.06 grams with packaging.
