Based upon the information contained therein, your Complainant believes the following to be true and correct: That at approximately 9:14 P.M. On November 21, 2025, Officer Haas was out on routine patrol with her Field Training Officer Lauden Rinzel when Officer Haas, while driving through the Walmart parking lot, observed a motor vehicle parked near the front of the store with a male party slumped over the driver’s wheel. Officer Haas also observed the vehicle to be running at the time. It should be noted that Walmart is located at [ADDRESS REDACTED] in the City of Cottage Grove, Washington County, Minnesota.
Officers Haas and Rinzel parked their squad and approached the suspect motor vehicle on foot. Officers observed several open shooter bottles. Officer Haas knocked on the driver’s side window. After some time the driver finally woke up and rolled down his window. The male party was identified as one DAVID ISAAC GALLEGOS, hereinafter referred to as “the Defendant.” The Defendant stated that he was homeless and had no where else to go so he was sleeping in his vehicle. During Officer Haas’ contact with the Defendant she observed a very strong odor of alcohol.
The Defendant admitted to consuming alcohol. Officer Haas, after finding the Defendant to be in physical control of the suspect motor vehicle, asked him to step out to perform roadside field sobriety testing. The Defendant agreed and performed poorly on a series of tests and then refused to blow when asked to submit to a PBT. Officer Haas, based on her observations of the Defendant and his performance on field sobriety testing, believed him to be impaired by alcohol and placed him under arrest for DWI. Officer Haas, due to the observed open containers of alcohol, searched the suspect motor vehicle and located several open but empty shooter bottles.
Officer Haas then observed an open shooter bottle with contents remaining in the inside the door pocket. Officer seized this container and placed it into evidence. Officer Haas transported the Defendant to the Cottage Grove Police Department. The Defendant was led to the booking room where Officer Haas read to the Defendant the Minnesota Breath Test Advisory. The Defendant declined the opportunity to consult with legal counsel and agreed to a requested breath test. Officer Gavin Foote, also with the Cottage Grove Police Department and a certified DataMaster operator, administered a DataMaster test to the Defendant.
That test revealed the Defendant’s alcohol concentration to be.20. It should be noted that this test was administered to the Defendant within two (2) hours of his being found to be in physical control of the suspect motor vehicle. Officer Haas conducted a check of the Defendant’s driving record. That check revealed that the Defendant he had the following alcohol history: Date: Offense: Location: 3/26/2025 Implied Consent Test w/MN License Rev. Ramsey County, Minnesota The 2025 alcohol incident and having an alcohol concentration of.20 both constitute aggravating factors under Minnesota's Impaired Driving Code.
