Officer Scholl returned to his squad and upon his second approach, the defendant had fallen asleep and was drooling. Trooper McCarty approached the vehicle. The defendant stated he was on his way to work and showed the trooper the GPS on his phone. The defendant’s hands were noticeably shaking. Trooper McCarty requested the defendant exit the vehicle to perform standardized field sobriety tests.
As the defendant walked to the front of his squad, Trooper McCarty observed he was noticeably unsteady and had to be guided. Trooper McCarty did not observe any clues during the Horizontal Gaze Nystagmus test. The defendant declined additional tests due to prior injury. A preliminary breath test showed an alcohol concentration of.00. During the Romberg test the defendant estimated 30 seconds as 35 seconds and then 40 seconds the second time. Trooper McCarty informed the defendant he was under arrest for DWI. While being searched, the defendant stated he takes methadone.
While searching the defendant’s vehicle, multiple spoons were located on the center console and tinfoil was located on the passenger floorboard, consistent with drug use. Inside a backpack behind the driver’s seat were multiple prescription pill bottles: Clonazepam, filled 10/31/25, with 4 pills remaining of 14. The physician’s instructions were to take one a day for anxiety.
