On December 13, 2025, Officer Milbauer with the Woodbury Police Department was on a routine patrol. Officer Milbauer was stopped at the stop sign at Westbound Hudson Road and Century Ave South and observed a black Toyota Highlander traveling southbound on Century Ave South. The Highlander activated its left turn signal on and turned into the turn lane. The vehicle waited for northbound traffic to clear before making a turn. However, instead of turning left, Officer Milbauer observed the vehicle turn its turn signal off, drive forwards and make a lane change back into the straight lane.
Officer Milbauer observed that the vehicle made this lane change while inside of the intersection and did not signal this turn. The vehicle continued to drive southbound on Century Ave South. As the vehicle approached Ridge Drive, Officer Milbauer observed it activate its left turn signal and start to turn into the left turn lane to turn onto Ride Drive. As the vehicle did so, it did not completely turn into the turn lane. Officer Milbauer observed the vehicle ride in between the turn lane and the straight lane.
Officer Milbauer then observed the vehicle turn onto Ridge Drive. Officer Milbauer observed the vehicle weave back and forth as it traveled eastbound on Ridge Drive as well as weave all the way onto the left-hand side of the road. Officer Milbauer initiated a traffic stop on the 6100 block of Ridge Drive. The driver was identified via his Minnesota Driver's license to be TAW HTOO PHA, [DOB REDACTED], Defendant herein. Officer Milbauer observed Defendant to have bloodshot and watery eyes, as well as slurred speech.
Officer Milbauer was also able to observe an odor of alcohol emitting from Defendant's breath. Officer Milbauer observed Defendant's difficulty in describing where he was heading. Defendant denied consuming alcohol and stated that he did not want to get in trouble. Defendant agreed to participate in standard field sobriety tests. Officer Milbauer, in accordance with his training, observed 6 of 6 possible clues of impairment. Defendant agreed to provide a preliminary breath test. However, during the tests, Defendant either did not blow, did not blow hard enough, got his tongue and lips in the way of the mouthpiece, or blew too hard.
Officer Milbauer was unable to get a PBT reading for Defendant. During this time, Defendant claimed he consumed four shots of alcohol. Defendant additionally stated that he was "impaired" and that there may be alcohol inside of his vehicle. Defendant was arrested for suspicion of driving while intoxicated. While in the back of Officer Milbauer's patrol vehicle, Defendant stated, "maybe I'm drunk, but I know what I am." Officer Milbauer asked Defendant which of his personal possessions from his car he wanted to bring with to the jail.
