Based upon the information contained therein, your Complainant believes the following to be true and correct: That at approximately 10:21 P.M. On November 2, 2025, Officer Davick was out on routine patrol traveling eastbound 70th Street in the City of Cottage Grove, Washington County, Minnesota, when he observed a Honda Pilot traveling ahead of squad straddling two eastbound lanes of 70th Street prior to the lanes being reduced to one lane. Officer Davick then observed the suspect vehicle to be braking as it was going up hill as well as traveling well below the posted 50 MPH speed limit.
Officer Davick, upon observing the suspect motor vehicle cross the right side fog line, initiated a traffic stop. Once stopped Officer Davick approached and identified the female driver via a Minnesota picture driver’s license as one ASMERET TEWOLDE KIFLE, hereinafter referred to as “the Defendant.” Officer Davick asked the Defendant where she was coming from. The Defendant stated a “baptism in St. Paul.” During Officer Davick’s contact with the Defendant he observed a strong odor of alcohol, the Defendant’s eyes to be bloodshot and watery and her speech to be slurred.
Officer Davick inquired how much she had to drink this evening. The Defendant stated “enough”. Once back up arrived on scene Officer Davick asked the Defendant to step from the vehicle to perform roadside field sobriety testing. The Defendant agreed and performed poorly on a series of tests. Officer Davick asked the Defendant to submit to a PBT test. The Defendant refused. Based on his observations of the Defendant as well as the observed driving conduct, Officer Davick believed the Defendant to be impaired by alcohol.
Officer Davick placed her under arrest for DWI. Officer Davick transported the Defendant to the Cottage Grove Police Department. The Defendant was led into the booking room where Officer Davick read to the Defendant the Minnesota Breath Test Advisory. The Defendant was afforded the opportunity to consult with legal counsel. When finished Officer Davick asked the Defendant to submit to a breath test. The Defendant agreed. Officer Davick, also a certified DataMaster operator, administered a DataMaster test to the Defendant.
That test revealed that the Defendant had an alcohol concentration of.21. It should be noted that this test was administered to the Defendant within two (2) hours of her operation of the suspect motor vehicle. Having an alcohol concentration of.21 constitutes an aggravating factor under Minnesota's Impaired Driving Code. PLEASE BE ADVISED THAT THE MAXIMUM BAIL/CONDITIONAL RELEASE REQUIREMENTS OF MINN. STAT. §169A.44 APPLY TO THE INSTANT CASE. The above facts constitute PROBABLE CAUSE to believe that on or about the 2nd day of November, 2025, in the City of Cottage Grove, Washington County, State of Minnesota, one ASMERET TEWOLDE KIFLE committed the above described offenses.
