All of the conduct described herein occurred within the County of St. Louis, State of Minnesota, unless otherwise noted. On June 5, 2026, at approximately 2:27 P.M., Duluth Police responded to a report of a suspicious male walking around Duluth Core Learning in the Burning Tree Plaza at [ADDRESS REDACTED] in the city of Duluth. The male was seen interacting with students and was unwanted at the property. The description of the male matched Justin Ryan McGraw [DOB REDACTED], hereinafter Defendant, who had a felony Department of Corrections warrant, which was known to Duluth Police officers.
Defendant has a history with Duluth Police, which includes fleeing, fighting, and resisting. Defendant had several cautions on his warrant to include assault on law enforcement, assault, threats of violence, fleeing in a motor vehicle and on foot, escape, and obstructing legal process. Defendant was located behind Savers at [ADDRESS REDACTED]. Officers exited their squad cars and Defendant was sitting in a grassy area facing away from officers. Officers announced themselves and told Defendant he had a warrant and was under arrest.
Defendant stood up and put his backpack on his shoulders before quickly dropping it and running away from officers. Defendant then suddenly turned towards officers and officers observed Defendant grab his pants and squared towards them in a fighting stance. Defendant was holding an object in his right hand. The situation was rapidly evolving and officers could not tell what the object was at first, but Defendant started closing the distance between them. Officers drew their handguns, and it was believed Defendant was holding a knife.
Defendant lifted his hand and swung the object at an officer. The officer backpedaled away from Defendant in an attempt to gain distance. The officer yelled "knife" several times. The officer believed Defendant was attempting to attack or injure him, and was within a few feet of the officer. Defendant yelled "f****** shoot me." The officer pointed his handgun at Defendant, and Defendant threw the object at him with force, missing the officer by a few feet. The object was later found to be a foot long piece of wood that had a pointy side to it.
Defendant was tackled to the ground. Defendant attempted to push officers off of him, tensing his body, and thrashing his legs. Defendant was ultimately arrested. Stat. 609.49, intentional failure to appear for duly scheduled court appearances may result in additional criminal charges, and in addition to any arrest warrant that may otherwise be issued by the Court.
