Based on reports from an incident occurring on or about June 2, 2024, your Complaint offers the following to establish probable cause: At approximately 6:00 A.M. On June 2, 2024, Minnesota State Patrol Troopers were dispatched to a fatal crash that occurred that morning near the intersection of I694 and 10th Street North in Oakdale, MN. A Nissan Cube and a Cadillac Escalade collided on I694 and C. G. H. Was pronounced dead at the scene. Highway traffic camera footage showed that the Nissan had abruptly stopped on I694 and was then struck from the rear by the Escalade.
The Nissan was being driven by C. G. H. And had one female passenger (N. S. K.). N. S. K. Was transported to the hospital via ambulance. Troopers spoke to N. S. K. At the hospital and she described what occurred prior to the collision. N. S. K. Said she and C. G. H. Had been arguing inside the car before the collision. During that argument, C. G. H. Stopped the Nissan on I694 and struck her in the face with his fist. N. S. K. Said this happened moments before the collision. The driver and sole occupant of the Escalade was identified as JACK PETER OKUMU [DOB REDACTED]. Traffic camera footage showed that both vehicles were traveling south on I694. The traffic camera footage showed that the collision caused the Nissan to go off the road and collided with a light pole.
The collision appears to have occurred when both vehicles were in the center lane of I694. Troopers reported that C. G. H. Had a valid driver's license at the time of the incident. There was no evidence that C. G. H. Suffered a medical condition or episode that would have contributed to the crash. An autopsy report showed the C. G. H. Had an ethanol concentration of.03 at the time of the collision. OKUMU denied using any drugs or consuming alcohol prior to the accident. However, OKUMU provided a PBT that yielded a result of 0.73. OKUMU then told Troopers that he had two glasses of wine during dinner the prior night.
Troopers reported suspicion of OKUMU being impaired and obtained a sample of OKUMU's blood via search warrant. A toxicology report showed that OKUMU's blood sample had an alcohol concentration of 0.067. The Minnesota Bureau of Criminal Apprehension (BCA) issued a retrograde extrapolation opinion based on OKUMU's statements about consuming alcohol the night before the accident. Based on OKUMU's statements, it is believed he consumed no alcohol after midnight, and any alcohol would have been substantially absorbed by the time of the collision.
Based on that information, a Forensic Scientist determined that OKUMU would have obtained an ethyl alcohol concentration of approximately 0.085-0.113 at the time of the crash. A driver's license and criminal history check revealed that OKUMU's driving status was cancelled-IPS. OKUMU was convicted of felony DWI in 2016 (Dakota County Court File No.: 19HA- CR-16-1453). OKUMU told Troopers there were no mechanical issues with his Escalade. OKUMU said that he usually keeps his cell phone on the passenger seat when he drives.
