Cloud, Sherburne County and observed a gold Mercury Grand Marquis, MN plate ETR313, parked at the gas pumps. He then observed a St. Cloud Police Department squad car pull nose‐to‐nose with the suspect vehicle, activating its emergency lights. The suspect vehicle reversed and left the parking lot. The St. Cloud squad pursued for a short distance and Deputy Wubben also pursued with emergency lights activated. The St. Cloud squad discontinued pursuit and pulled over. Sergeant Brian Cameron of the St. Cloud Police Department informed Deputy Wubben that this was the third time the vehicle had fled from law enforcement.
Two times were in Stearns County and now in Sherburne County. Deputy Wubben continued to patrol the area of Highway 10, County Rd 16, and County Rd 3. While traveling eastbound on County Rd 3, Deputy Wubben observed a vehicle approach his squad traveling 63mph in a 55mph zone. As the vehicle continued approaching, Deputy Wubben confirmed it was the suspect vehicle. Near the intersection with County Rd 7, St. Cloud, Sherburne County, at approximately 1:43am, Deputy Wubben got behind the suspect vehicle.
The vehicle immediately accelerated away from his squad. Deputy Wubben activated his radar and clocked the vehicle at over 80 mph. Deputy Wubben activated his emergency lights and sirens and advised dispatch he was in pursuit of the vehicle. The vehicle traveled west on Highway 10. Deputy Wubben observed the vehicle appeared to be occupied by only the driver, who appeared to be male. While pursuing the vehicle west on Highway 10, the vehicle reached speeds of 110mph. There were no other vehicles traveling in the same direction at the time of the pursuit.
Benton County placed stop sticks near Highway 10 and Highway 23 which partially disabled the vehicle. It continued traveling westbound in the eastbound lanes of Highway 10, then through the west ditch of Highway 10 and north onto Franklin Ave NE. Due to the evasive maneuver, Deputy Wubben lost sight of the vehicle but located it crashed in the ditch near the Franklin Office Center. The vehicle was now unoccupied with the driver’s door open. Several agencies set up a perimeter and began a K9 track.
The defendant was ultimately located in a semi parking lot with eight‐foot fences and taken into custody at approximately 3:01am. The total pursuit distance of the fourth flee in a motor vehicle was 5.67 miles. PLEASE TAKE NOTICE: Pursuant to Minn.
