That on or about November 1, 2025, at 10:44 A.M., Officers with the St. Louis Park Police Department were dispatched to the parking lot of the Double Tree Hotel, located at [address omitted]., in the City of St. Louis Park, County of Hennepin, State of Minnesota, on a report of possible overdose inside a 2008 Silver Honda Civic with MN Plate SND-944 (“suspect vehicle” herein). The Reporting Party stated the male in the driver’s seat of the suspect vehicle appeared to be seizing or overdosing. The registered owner of the suspect vehicle was determined to be NICHOLAS DAVID LENHARDT (“Defendant” herein). Upon arrival, Officers observed the suspect vehicle was on and the Defendant was in the driver’s seat.
Officers contacted Defendant and noticed that he was awake. In plain view inside the suspect vehicle, Officers observed an open bottle of New Amsterdam Vodka on the front passenger seat. There was a tiny amount of vodka inside the bottle of New Amsterdam. While speaking with Defendant, Officers smelled the odor of consumed alcohol emanating from Defendant’s breath. Officers observed Defendant to have red and watery eyes, coupled with slurred and mumbled speech. Defendant informed Officers he consumed two beers prior to driving the suspect vehicle.
Officers administered field sobriety tests, on which Defendant performed poorly. Officers next administered a preliminary breath test (PBT). Defendant provided a breath sample into the PBT, which resulted in a BAC reading of.225. Based on the indicia of intoxication, Defendant was placed under arrest and transported to the St. Louis Park Police Department for additional testing. Officers read Defendant the Minnesota Breath Test Advisory. Defendant stated he understood, elected to speak with an attorney, and refused to take the DataMaster Test (DMT). Officers ran a routine check on Defendant and discovered he had a prior third-degree DWI conviction from 2023 in court file number ••-CR-••-••••. Defendant’s probation in court file number ••-CR-••-•••• is scheduled to expire on December 15, 2025. At present, Defendant is in custody.
