Officer Graff located the Glock 19 handgun that Kelly had tossed into the snow. The gun was loaded with an extended magazine, holding approximately 30 9mm rounds along with one 9mm round in the chamber. After Holliday was arrested and placed into the backseat of Officer Bagan's squad car, Officer Bagan read him a Miranda warning and took a statement from him. Holliday said that he gave Kelly a ride that night in exchange for gas money. He said that, after Officer Freeman began trying to pull him over, Kelly told him not to stop because he had "stuff on [him]." Holliday confirmed that he saw Kelly with a gun.
Holliday initially identified himself as "EVHAN MAURICE HOLIDAY" with a date of birth of October 23, 2007. He did not have identification on him. Officer Bagan was able to see that that identity belonged to a real person and later contacted Holiday's mother to confirm his identity. After he sent a photograph of the suspect to Holliday's mother, she confirmed that the person in custody was her son, but was Eric Holliday and not Evhan Holliday. Evhan Holliday is her other son. She confirmed that Evhan Holliday was a real person and was at her home, sleeping.
Officer Bagan confirmed his full name and date of birth and found 2 82-CR-25-5412 Filed in District Court State of Minnesota 12/17/2025 that he had multiple felony warrants out of Washington, Hennepin, and Ramsey counties. Kelly was previously convicted of Aid/Abet Aggravated First Degree Robbery in Court File No. 27-CR-24- 21002 on September 30, 2025, and is therefore ineligible to possess a firearm.
