On or about November 2, 2025, at approximately 5:13 PM, officers of the Crystal Police Department responded to motor vehicle accident report in the area of [ADDRESS REDACTED] N, City of Crystal, Hennepin County, Minnesota. Upon arrival, two parked vehicles were seen, one of which appeared to have been hit. According to the call note, one of the vehicles was parked when the other vehicle, driven by CHRISTOPHER MYRON NICH HORNING, [DOB REDACTED], the Defendant herein, collided with it. Officers made contact with Defendant, who was noted to have bloodshot, watery eyes and slurred speech.
An odor of a consumed alcoholic beverage was detected and was so strong as to be nauseating to the officer. Defendant admitted to hitting the parked vehicle. Defendant further admitting to drinking "before the game." An officer proceeded to conduct standardized field sobriety tests on Defendant, who exhibited several signs of impairment during the tests. During testing, paramedics arrived and evaluated Defendant. No further testing was attempted as Defendant appeared uneasy on his feet after examination.
A preliminary breath test was attempted, however Defendant refused to provide a breath sample. Defendant was placed under arrest for DWI and was transported to Crystal Police Department. Defendant was read the breath test advisory and Defendant stated he understood. Defendant was provided attorney time, however Defendant refused to look through the provided attorney books. Defendant refused to provide a breath sample for the DMT. A prior qualifying conviction was noted from 10/7/2021 in court case: 62SU-CR-21-1369.
