On March 23, 2026, J. J. Reported to Carver County Sheriffs that Durell Lamarr Mitchell (2-5-1988), hereinafter Defendant, had picked up her three minor children (birth year 2024, 2023, 2018) from Chanhassen KinderCare at 2:37 P.M. Without permission to do so and without legal rights to do so. Defendant has no legal rights to any of the children. Two of the children are his biological children but the child born in 2018 has a different biological father. Defendant has no rights to that child, nor to the other two.
There is currently a DANCO in place preventing Defendant from contacting J. J. Defendant has not seen or cared for any of the children since March 7, 2026. J. J. Obtained an order for protection on March 20, 2026, in Carver Court File 10-FA-26-92, which prohibits Defendant from having any contact with the children. Defendant as of March 23 had not been served with the OFP. J. J. Reported she received a phone call the children had been picked up and was confused. She contacted Hennepin County Dispatch and asked for a welfare check where she believed Defendant was living in Brooklyn Center.
Meanwhile, Brooklyn Center PD went to the address to attempt to serve Defendant with the OFP and were told Defendant does not reside there. Police again responded and observed Defendant's vehicle in driveway and heard people inside but nobody answered the door. J. J. Expressed concern for her children and their safety and did not believe Defendant had necessary items to care for a 1 and 2 year old. An additional welfare check was performed at the Brooklyn Center address and all three children were located.
J. J. Was able to pick the children up and Defendant was served with the OFP. J. J. Had not communicated with Defendant since March 7, 2026 and did not give Defendant permission to pick the children up on March 23. The children were picked up by Defendant without prior notice, preparation, or communication to J. J. PLEASE TAKE NOTICE: Pursuant to Minn. Stat. 609.49., intentional failure to appear for duly scheduled court appearances may result in additional criminal charges, and in addition to any arrest warrant that may otherwise be issued by the Court.
