Based on reports from an incident occurring on or about January 30, 2026, your Complaint offers the following to establish probable cause: At approximately 3:30 P.M. On January 30, 2026, a Washington County Deputy Sheriff was on routine patrol traveling westbound on Highway 36 just past Manning Trail North. A gold four-door sedan bearing Minnesota license plate [PLATE REDACTED] drove past the deputy. The vehicle drove through traffic and made aggressive lane changes. During the lane changes, the vehicle failed to use its blinker two times.
On multiple occasions the vehicle was also observed crossing over the center line. At one point, the vehicle made an aggressive lane change and cut off another vehicle. The deputy activated his emergency lights to initiate a traffic stop. The vehicle then traveled a short distance before entering the right turn lane at the intersection of Highway 36 and Demontreville Trail in Lake Elmo, MN. The driver of the vehicle then drove straight through the intersection and continued traveling on the right shoulder of the roadway.
The car then drove back into the right lane of traffic, pulled back onto the shoulder, and came to a stop. The deputy approached the vehicle from the passenger side and the driver exited the vehicle without prompting. The driver reentered the car after several commands. The driver was identified as SUSAN MARIE NIEDZIELSKI [DOB REDACTED]. The deputy detected a strong odor of alcohol coming from NIEDZIELSKI and she had slurred speech. NIEDZIELSKI produced an invalid driver's license and had no proof of insurance.
The deputy checked NIEDZIELSKI driving status and reported it had a restriction for alcohol and controlled substance. The deputy returned to the vehicle and asked NIEDZIELSKI to step out of the car. NIEDZIELSKI refused to exit the vehicle. It took two deputies to remove NIEDZIELSKI from the vehicle. NIEDZIELSKI then became loud and belligerent. The deputy reported that NIEDZIELSKI was uncooperative and would not perform Standard Field Sobriety Tests. NIEDZIELSKI did provide a PBT sample, which yielded a result of.08 BAC. NIEDZIELSKI was arrested and transported to the Washington County Jail.
A deputy read the Implied Consent Advisory to NIEDZIELSKI. After several minutes, NIEDZIELSKI called an individual who the deputy did not believe was an attorney. NIEDZIELSKI then said she was refusing the breath test. NIEDZIELSKI was convicted of felony DWI on June 16, 2010.
