On October 31, 2025, at approximately 6:49 P.M., Deputy Phillips was southbound Highway 52 north of 500th Street in Goodhue County, Minnesota. Deputy Phillips observed a vehicle in his mirror at a high rate of speed. Deputy Phillips activated his radar and got a speed reading of 87 mph. The target vehicle was pulling away from the other vehicles at a high rate of speed. Once the target vehicle got next to him, the driver slammed on the brakes. Deputy Phillips slowed down to let the vehicle pass him.
The vehicle did not pass him and put on their turn signal and got behind him. Deputy Phillips pulled over to the shoulder to let the vehicle pass him. Deputy Phillips got back onto the road and got behind the vehicle, which was a 2010 Red Acura ATL bearing Minnesota license plate [PLATE REDACTED]. Deputy Phillips activated his emergency lights and the vehicle moved to the right shoulder. Deputy Phillips made contact with the driver and single occupant. The driver was identified as JERMAINE LAMONTE COLLINS [DOB REDACTED]. Deputy Phillips immediately detected a strong and distinct odor of alcohol coming from the vehicle.
COLLINS said he was coming from Mystic Lake and was going to Rochester. Deputy Phillips asked COLLINS how much he had to drink, and COLLINS denied drinking. Deputy Phillips asked COLLINS if he would pass field sobriety tests and he stated he would. Deputy Phillips checked COLLINS' [DL# REDACTED], which was valid and he was clear of warrants. Deputy Phillips went back up the to the vehicle, this time on the driver’s side. Deputy Phillips asked COLLINS to step out. Deputy Phillips had COLLINS walk to the front of his patrol vehicle.
Deputy Phillips smelled a strong smell of alcohol coming from COLLINS. Deputy Phillips shined his flashlight at COLLINS’s eyes and observed bloodshot, watery eyes. COLLINS asked if he needed to do field sobriety tests, Deputy Phillips told him he did not. Deputy Phillips requested that COLLINS provide a preliminary breath sample (PBT). COLLINS asked if he had to and Deputy Phillips said he did not. COLLINS declined to provide a PBT. Deputy Phillips advised COLLINS if he did not perform his tests he would be placed under arrest for DWI. COLLINS again declined to do the tests.
Due to the overwhelming smell of alcohol, speed, not willing to pass my patrol vehicle once Deputy Phillips slowed, the bloodshot watery eyes, and coming from an establishment that sells alcohol, Deputy Phillips decided to place COLLINS under arrest. Deputy Phillips advised COLLINS he was under arrest. COLLINS was transported to Zumbrota Police Department (ZPD) for testing. COLLINS immediately burped, so the observation time was restarted at 7:25 P.M. COLLINS was read the Breath Test Advisory. COLLINS stated he would like to speak with an attorney.
