On April 10, 2026, at approximately 2:00 A.M., an officer was stationary at Century Avenue and Interstate 94 East in Maplewood, Ramsey County, Minnesota, when they observed a vehicle exiting onto Century Avenue without headlights or taillights illuminated. The officer followed the vehicle and observed it cross over the lane lines multiple times as well as drift to the right and nearly strike the curb. The officer effectuated a traffic stop at Century Avenue and Lower Afton Road. The driver was identified as ASHTON JAKE JOHNSON-MONTGOMERY – [DOB redacted]. While speaking with JOHNSON- MONTGOMERY, the officer noticed that his pupils were restricted, he was very animated, he fidgeted a lot, and he exhibited signs of methamphetamine use.
An officer conducted field sobriety tests. During the tests, JOHNSON-MONTGOMERY did not exhibit following signs of alcohol impairment: lack of smooth pursuit, distinct and sustained nystagmus at maximum deviation, and vertical nystagmus. During the walk and turn test, JOHNSON-MONTGOMERY swayed while balancing and started the test before he was instructed to do so. In addition, JOHNSON- MONTGOMERY used his arms for balance, did not touch heel to toe, conducted an improper turn, and lost his balance during the turn.
During the one leg stand test, JOHNSON-MONTGOMERY swayed while balancing, used his arms for balance, hopped, and counted improperly. During the lack of convergence test, the officer observed a lack of convergence during the first test but did not observe this on the second or third iterations. JOHNSON-MONTGOMERY did not exhibit signs of impairment during the modified Romberg test. During the finger to nose test, JOHNSON-MONTGOMERY made unusually slow, deliberate movements and did not touch the tip of his nose as instructed.
JOHNSON-MONTGOMERY complied with a PBT test, which yielded a result of 0.00 BAC. JOHNSON-MONTGOMERY was taken into custody for suspicion of driving while under the influence of a controlled substance. Police obtained a search warrant, which ordered JOHNSON-MONTGOMERY to provide a blood or urine sample. JOHNSON-MONTGOMERY refused to provide a blood or urine sample and acknowledged that refusal to provide a sample was a crime. The officer read JOHNSON- MONTGOMERY a Miranda advisory. JOHNSON-MONTGOMERY stated that he already knew what the officer was going to say then covered his ears with both hands and refused to acknowledge his rights.
In a search of the vehicle, police located a plastic baggie containing suspected narcotics inside the driver’s door. Presumptive testing yielded a positive result for methamphetamine with a net weight of.39 grams.
