That on or about 12/30/2025, at approximately 1:57 A.M., MPD officers Davids and Hopper were on routine patrol when they observed a green Saturn Vue vehicle, MN 013 AA7, in the Bohemian Flats park’s parking lot after hours, in Minneapolis, Hennepin County, MN. The parking lot has visibly posted signage of no parking 12am -6am. Also, the park closes at 12midnight. The officers observed the vehicle’s lights were illuminated and large billows of smoke poured out of the open front driver’s window and a rear passenger window.
The officers approached the vehicle and observed four occupants, a male in the driver’s seat, and the vehicle key was in the ignition. In plain view the officers also observed in the center console between the front driver and passenger seat a clear plastic bag containing a green bud substance of suspected marijuana. They also observed the odor of marijuana emanating from the vehicle. The observed that the eyes of the male in driver’s seat were bloodshot and watery. The driver was later identified as being Moose, Rolland Dean, [DOB REDACTED], Defendant herein.
While Defendant claimed to have left his driver’s license at home, squad DVS checks revealed that Defendant did not have a Minnesota driver’s license. However, Defendant admitted they were parked there smoking marijuana. Routine checks revealed that none of the occupants had a valid driver’s license, and two of the four occupants were under the age of 18. Standardized field sobriety tests were administered to Defendant. During the HGN test, the officer observed clues of impairment including distinct and sustained nystagmus at maximum deviation in both eyes.
Defendant struggled with divided attention and working memory as he failed to follow test instructions and failed to follow the stimulus. During the Lack of Convergence (LOC) test, the officer observed Defendant’s eyes failed to converge. During the WAT test, Defendant continued to struggle with divided attention and working memory as he failed to follow instructions. He forgot the instructions, started too soon, abruptly stopped walking during the test, had to be re-directed to take the 9 steps down and then back.
During the Finger to Nose test, Defendant again failed to follow instructions by using the wrong hand. A Modified Romberg test (MRT) was administered during which the officer observed Defendant’s eyelids fluttered and his internal clock was sped up as he counted the passage of 30 seconds in only 20 elapsed seconds. Defendant was arrested for DWI and transported to the Chem Test Room at the HCJ. The vehicle was inventoried and towed. During the inventory search, officers discovered four cartridges containing liquid THC, and a loaded semi-automatic pistol, Ruger LCP MAX, serial number T20260018712, was found under the front passenger seat along with a magazine containing a live round.
