M., Officer Krimouski was driving on Bloomington Road from Highway 62, in the jurisdiction of the Metropolitan Airports Commission, County of Hennepin, State of Minnesota when he observed a black 2021 Ram 1500 bearing Minnesota license plate [PLATE REDACTED] that was parked in the exit lane of traffic in front of a stop sign outside the Base Camp parking lot. Officer Krimouski parked behind the vehicle and approached on the passenger side where he observed a male, later identified by his Minnesota identification card as the above-named Defendant FRANCISCO JOAQUIN CABALLERO, [DOB REDACTED] sleeping in the driver’s seat.
Officer Krimouski observed that the vehicle was running. Officer Krimouski also observed an open and nearly empty container of Two Chicks vodka lemon, strawberry and basil seltzer in the center console. Additional Officers arrived on scene to assist. Officer Krimouski turned off the vehicle from the passenger side door and then made contact with Defendant. Officer Krimouski immediately smelled a strong odor of a consumed alcoholic beverage emanating from the interior of the vehicle and observed that Defendant had bloodshot, watery eyes, and extremely slurred speech.
When asked, Defendant admitted that he had consumed three beers with his last beer being consumed four hours prior. Officers asked Defendant to exit the vehicle and Defendant complied. Officers observed that Defendant had poor balance once outside the vehicle. Officers conducted the Horizontal Gaze Nystagmus Test, the Walk and Turn Test, and the One Leg Stand Test, which Defendant was unable to satisfactorily perform. Officers obtained a manual sample for a PBT, which provided a reading of.09 BAC. Defendant was placed under arrest and transported to the Police Operations Center.
Defendant was read the Minnesota Breath Test Advisory. Defendant stated that he understood the advisory and wanted to consult with an attorney. Officers provided Defendant with a phone and several attorney directories at 1:37 A.M. Officers observed that Defendant made several phone calls. At approximately 2:22 A.M., Defendant stated that he would take the breath test. Defendant provided a breath sample for the DataMaster DMT, which provided a reading of.17 BAC at 2:28 A.M. A routine check on Defendant’s record revealed that Defendant has one prior driving while impaired-related driver’s license withdrawal dated October 30, 2022 and one prior under 21 drinking and driving conviction dated November 10, 2022. The check also revealed that Defendant has a revoked driver’s license status.
