11/18/1969 (56), violated the law as set forth herein. On March 7, 2026, at approximately 11:11 PM, Alexandria Police Officer Makenzie Uhl conducted a traffic stop of a vehicle that had a license plate light out and an object suspended from the rear-view mirror. The Defendant was identified as the driver of the vehicle. While speaking with the Defendant, Ofc. Uhl observed the following indicators of recent drug use: bloodshot eyes, excessive blinking, eyelid tremors, fidgeting, nervousness, inconsistent speech rate, lip smacking indicating a dry mouth, and a thick white substance on the Defendant’s tongue.
The Defendant admitted to consuming one alcoholic beverage earlier in the evening but denied using any other non- prescribed drug. Based upon these observations, Ofc. Uhl had the Defendant step out of the vehicle to perform field sobriety tests. During the Horizontal Gaze Nystagmus (HGN), Ofc. Uhl observed lack of smooth pursuit but no distinct and sustained nystagmus. During this test, the Defendant had facial tremors, swayed while standing still, and did not follow directions. During the Lack of Convergence test, Ofc.
Uhl noted lack of convergence. During the Walk and Turn, the Defendant had a hard time following directions and multitasking. He was unable to maintain his balance in the starting position, stepped off the line, took an incorrect number of steps, used his arms for balance, and conducted an improper turn. During the One-Leg Stand, the Defendant used his arms to balance, swayed, and put his foot down multiple times. During the Modified Romberg test, Ofc. Uhl again noted eyelid and lip tremors. The Defendant estimated 27 seconds, which is within normal parameters.
During the Finger-to-Nose test, the Defendant consistently missed the tip of his nose. The Defendant provided a preliminary breath test (PBT) sample with a result of.018. Based on the multiple observed indicators of impairment, the Defendant was arrested for suspicion of driving while impaired by a controlled substance. Ofc. Uhl searched the Defendant incident to arrest and found a small vial of a crystal-like substance in the Defendant’s front left pocket. The substance field-tested positive for methamphetamine, a Schedule II controlled substance, weighing 1.5 grams.
Ofc. Uhl then searched the Defendant’s vehicle and located a small case with similar crystal-like substance in a small black coin purse next to the driver’s seat, a used methamphetamine pipe, and a bag of marijuana. PLEASE TAKE NOTICE: Pursuant to Minn. Stat. § 609.49, intentional failure to appear for duly scheduled court appearances may result in additional criminal charges in addition to any arrest warrant that may otherwise be issued by the Court.
