On or about November 14, 2025, at approximately 9:35 PM, officers of the Blaine Police Department responded to a driving conduct complaint. Officers were advised of a driver, later identified to be JOSE LUIS DIAZ OSORIO, [DOB REDACTED], the Defendant herein, almost hitting cars and crossing the median line. Officers were pointed out the vehicle parked with its lights on in the driveway of 107 113th Sq, City of Blaine, Anoka County, Minnesota. As an officer approached the vehicle, Defendant was noted to be passed out in the driver's seat holding his phone.
The vehicle was also still running. Defendant was noted to be breathing. The officer turned on his squad's emergency lights, re-approached the vehicle, and woke up Defendant by knocking. Defendant opened the door and an immediate overwhelming odor of alcoholic beverage. Defendant advised he was arriving home and didn't speak much English. The officer asked in Spanish how many drinks Defendant had, who replied with "maybe two." The officer activated his interpreter application and connected with an interpreter.
The officer proceeded to conduct standardized field sobriety tests, during which Defendant showed several signs of impairment. A preliminary breath test revealed Defendant had a BAC of 0.187. Defendant was placed under arrest and transported to Blaine Police Department. Defendant was read the breath test advisory using an interpreter. Defendant stated he understood and spoke with an attorney. Defendant agreed to take the test and provided a final sample of 0.18 BAC. Defendant had no prior qualifying convictions upon review of his record.
